1. Introduction

These Terms of Service ("Terms") govern your use of the Janey the Artist website and the commission services we provide. By commissioning artwork or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not commission artwork or use our services.

2. Commission Process

Ordering a Commission

We offer custom artwork commissions available through our Store and Portfolio sections. Some commissions are available at fixed prices for immediate purchase, while others require a consultation and custom quote. For current pricing and availability, please visit our Store or Portfolio pages.

Timeline

Work typically begins within 3-4 days of payment. Specific completion timelines vary by commission type and complexity, and will be communicated when you place or accept your order. These are estimates and may vary based on project complexity and revisions.

Consultation (Custom Commissions)

For custom commission inquiries, we will discuss your vision, requirements, budget, and timeline. These consultations are free and without obligation. Following consultation, we will provide a detailed quote. To proceed, you must accept the quote and agree to the proposed price and timeline.

3. Payment Terms

Payment Requirement

Full payment must be received before work begins on your commission. For fixed-price commissions, payment is made immediately through our store checkout. For custom quote commissions, payment is requested once you accept the quote. All payments are processed securely through Stripe and cover the complete artwork as specified.

Accepted Payment Methods

We accept all major credit and debit cards through Stripe. Payment is processed securely and we do not store your card details.

Currency and Pricing

All prices are quoted in British pounds (£). Shipping costs are included for UK deliveries. We currently only deliver to UK addresses. For international inquiries, please contact us.

4. Revisions and Changes

Revision Policy

All commissions include one round of revisions to address any changes you'd like to make to the artwork. Revisions include adjustments to elements such as colours, composition, or specific details as discussed during consultation or acceptance of the initial artwork.

If you require additional revisions beyond the included round, please contact us. We're happy to discuss your needs on a case-by-case basis and may be able to accommodate further revisions at no additional cost depending on the scope and complexity of your requests.

Scope Changes

Scope changes are requests that significantly extend the work beyond the original agreement, such as adding additional subjects or major design changes. If you request scope changes, we will discuss with you whether they can be accommodated within the revision allowance or if an additional fee applies.

Final Artwork

Once your artwork is complete, you will receive a photo of the final piece for your approval before delivery or digital file transfer.

5. Cancellations and Refunds

Full refunds are available if you cancel your commission before we begin work. Once work has commenced, refunds are no longer available. For detailed information about our refund policy, including timelines, conditions, and request procedures, please refer to our Refund Policy.

6. Intellectual Property and Ownership

Artwork Ownership

Upon full payment, you own the physical artwork or digital file as applicable. You may display and modify the artwork for personal use. You may not reproduce, resell, or use the artwork commercially without written permission from us.

Artist Rights

We retain the right to photograph, display, and share images of completed artwork on our website, portfolio, and social media for promotional purposes unless you explicitly request otherwise. If your commission contains identifiable people, we will obtain separate consent before sharing on social media. We may reference your commission as an example of our work in promotional materials.

Copyright

The design and creative work remain our intellectual property, but you receive the right to use and display the finished artwork. You may not reproduce or resell the artwork commercially without written permission.

7. Shipping and Delivery

Shipping Methods

Artwork is carefully packaged and shipped via reputable tracked courier services to UK addresses only. Shipping costs are included in the commission price for UK deliveries. We will send you an email with tracking details when your artwork is dispatched.

Delivery Timeline

Most UK deliveries arrive within 48 hours of dispatch. However, delivery times depend on your location and courier schedules. We are not responsible for delays caused by courier services beyond our control.

Damage in Transit

Damage during shipping is extremely rare. If your artwork arrives damaged, please notify us immediately with photographic evidence. We will assist you in filing a claim with the courier, whose insurance typically covers damage claims. If the claim is unsuccessful, we will discuss replacement or refund options with you. Digital Delivery

For digital artwork, files will be provided via email or cloud storage link within 2-3 business days of your approval of the final piece. You are responsible for maintaining your own backup copies of digital files.

8. Service Availability

Availability of services varies by location. Please check our Portfolio section for current offerings and geographic availability. For commissions outside our standard service area, please contact us to discuss options.

9. Limitation of Liability

We take great care to deliver high-quality artwork. However, we are not liable for:

  • Loss, theft, or damage to artwork after delivery (covered by courier insurance)
  • Colour variations due to different screens, monitors, or lighting conditions
  • Delays caused by courier services or circumstances beyond our control
  • Changes to artwork after delivery (normal wear and tear)

Our total liability is limited to the amount paid for the commission.

10. Communication

We communicate primarily via email. It is your responsibility to:

  • Provide accurate contact information
  • Check emails regularly for updates and requests for approval
  • Respond to requests for information or approval in a timely manner
  • Notify us of any changes to your address or contact details

11. Website Use

When using our website, you agree to:

  • Not engage in any unlawful or harmful conduct
  • Not attempt to hack, disrupt, or damage the website
  • Not reproduce content without permission
  • Respect our intellectual property rights

12. Changes to These Terms
